4. Definitions

  • Goods (Products): Any item offered for sale on the Website.
  • Seller (We/Us): The operator of this online store.
  • Buyer (You): Any person purchasing through this Website.
  • Consumer: A natural person acting outside their trade, business, or profession.
  • Contract: The purchase agreement concluded between Buyer and Seller online.
  • Warranty (Legal Guarantee): Statutory consumer rights provided under EU law, and any voluntary additional guarantees offered by the Seller.

5. Applicable Law

These Terms are governed by European Union law and supplemented by relevant Hungarian national law where appropriate, including:

  • Directive 2011/83/EU on Consumer Rights
  • Directive 2000/31/EC on Electronic Commerce
  • Directive (EU) 2019/771 on the Sale of Goods
  • Directive (EU) 2019/770 on Digital Content and Services
  • Regulation (EU) 2016/679 (GDPR)

For non-EU consumers, these Terms will apply on a contractual basis, unless mandatory local consumer protection rules prevail.

6. Scope of the GTC

These GTC form part of every purchase made on our Website and regulate ordering, payment, delivery, warranties, liability, and withdrawal rights.

7. Contract Language and Form

The contract language is English. All contracts are concluded electronically and not filed by the Seller.

8. Electronic Invoices

By accepting these Terms, you agree to receive invoices in electronic format.

9. Prices and VAT

All prices are displayed in Euros (€) by default. Customers may also view estimated prices in US Dollars ($) using the currency selector.

Currency conversion: The final amount charged is always based on the Euro (€) price. Prices displayed in other currencies are provided for information only. The amount charged in the customer’s local currency may vary depending on the exchange rate and fees applied by their bank or payment provider.

We operate under the Hungarian small business VAT exemption. For eligible European Union delivery destinations currently available in our webshop, VAT exemption is applied under the EU cross-border SME scheme. Therefore, no VAT is added to eligible orders at checkout.

For deliveries outside the European Union, no Hungarian VAT is charged. The recipient is responsible for any customs duties, import taxes and customs clearance fees imposed by the destination country or delivery carrier. These charges are not included in the product price or shipping cost.

10. Ordering Process & Contract Formation

Orders are placed online. When you click “Place Order”, you submit a binding offer. The contract is concluded when you receive our confirmation email.

If you do not receive confirmation within 48 hours, your offer is deemed withdrawn.

11. Payment Methods

We use Stripe for secure payment processing. Supported methods:

  • Credit/Debit cards (Visa, MasterCard, Maestro, American Express)
  • Apple Pay (Safari on Apple devices)
  • Google Pay (Chrome with linked Google account)

Payment is due immediately upon order confirmation and includes the applicable shipping cost.
All payments are processed securely in compliance with PCI DSS standards, and our website uses SSL encryption to protect your data.

To ensure a secure and successful transaction, the use of certain technical cookies (e.g., Stripe fraud prevention) is required. If these are blocked by your browser settings or third-party tools, the payment process may be interrupted.

12. DELIVERY AND SHIPPING

12.1 Delivery Time

Unless otherwise agreed, the Seller will deliver the goods without undue delay and no later than 30 calendar days after the conclusion of the contract.

The estimated processing and delivery time applicable to each product is displayed on the relevant product page.

12.2 Shipping Methods and Costs

Available shipping methods, estimated delivery times and shipping costs may vary depending on the destination country and the products ordered.

The applicable shipping cost is calculated and displayed at checkout before the order is submitted.

Shipping costs are borne by the Buyer unless free shipping applies under Section 12.3.

12.3 Free Shipping within the European Union

Free standard tracked shipping is available for orders delivered to eligible European Union destinations currently available in the webshop, excluding Hungary, where the final product subtotal is EUR 200 or more.

The qualifying product subtotal is calculated after all coupons, discounts and promotional reductions have been applied and does not include shipping charges.

Free shipping is applied automatically at checkout when the applicable conditions are met.

This offer does not apply to deliveries outside the European Union.

12.4 Shipping Destinations

The Seller ships only to countries that are available for selection during checkout.

If the Buyer’s country is not listed at checkout, the Buyer may contact the Seller at order@dotandpaint.com to ask whether an individual shipping arrangement is possible.

The availability of shipping to a particular destination may change depending on carrier availability, legal requirements and delivery conditions.

12.5 Tracking

All orders are shipped using a tracked delivery service. The tracking number or tracking link will be provided after the order has been dispatched.

12.6 Customs, Duties and Import Taxes

For deliveries outside the European Union, customs duties, import taxes and customs clearance fees may be charged by the destination country or delivery carrier.

These charges are not included in the product price or shipping cost and are the responsibility of the recipient.

The Seller is not responsible for delays caused solely by customs clearance procedures or by the recipient’s failure to provide information or pay charges required by the destination country.

12.7 Transfer of Risk

The risk of loss of or damage to the goods passes to the Buyer when the Buyer, or a third party designated by the Buyer other than the carrier, takes physical possession of the goods.

If the Buyer independently appoints a carrier that was not offered by the Seller, the risk passes to the Buyer when the goods are handed over to that carrier.

12.8 Lost, Damaged or Delayed Shipments

If an order is lost, damaged or significantly delayed, the Buyer should contact the Seller as soon as reasonably possible at order@dotandpaint.com.

The Buyer may be asked to provide the order number, photographs of the damaged product and packaging, and any other information reasonably required for the carrier investigation.

The Buyer should retain the damaged product and all packaging materials until the claim has been reviewed.

This notification requirement does not limit the Buyer’s statutory consumer rights.

12.9 Custom-Made and Personalised Products

The statutory right of withdrawal does not apply to goods made to the Buyer’s specifications or clearly personalised.

13. Right of Withdrawal (EU Consumers)

Under Directive 2011/83/EU, EU consumers may withdraw from the contract within 14 calendar days of receiving the goods without giving reasons.

  • Withdrawal must be notified by email or using the Model Withdrawal Form.
  • Goods must be returned within 14 days, at the consumer’s cost.
  • Refunds will be processed within 14 days using the original payment method, excluding extra shipping upgrades.
  • We may withhold the refund until goods are returned or proof of return is provided.

Exclusions: No withdrawal right for custom-made or clearly personalised goods.

Non-EU consumers: We voluntarily extend the same 14-day withdrawal right, unless mandatory local law provides otherwise.

14. Legal Guarantee (Statutory Warranty)

In line with Directive (EU) 2019/771, consumers in the EU have a 2-year legal guarantee for faulty goods.

  • Remedies: Repair or replacement, or if not possible, price reduction or refund.
  • Defects discovered within 1 year are presumed to have existed at delivery unless proven otherwise.
  • Claims must be reported within a reasonable time (max. 2 months after discovery).

For non-EU sales, we offer the same 2-year guarantee voluntarily, unless local mandatory rights apply.

15. Digital Content and Updates

Under Directive (EU) 2019/770, digital content (e.g., downloads) will be supplied in the latest version and updated as necessary for conformity during the agreed period.

16. Dispute Resolution

  • EU Consumers: May use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/
  • ADR: Alternative dispute resolution bodies may also be used, but prior direct contact with the Seller is required.
  • Non-EU Consumers: Disputes will be handled under EU ADR principles on a voluntary basis unless local mandatory law applies.

17. Limitation of Liability

We are not liable for:

  • Customs duties or delays outside the EU.
  • Minor variations in colour or texture due to the handmade nature of goods.
  • Defects caused by misuse or improper handling by the buyer.

18. Miscellaneous

  • No business-to-business sales: We sell only to consumers (private individuals).
  • Governing jurisdiction: EU consumer law applies. Non-EU disputes will be heard in Hungarian courts, without prejudice to mandatory consumer rights in your country.
  • Severability: Invalid clauses do not affect the remainder of these Terms.
